ARTICLE 1 - DEFINITIONS

  • Consumer: A natural person not acting in the exercise of a profession or business.

  • Entrepreneur: FragranceGems.

  • Agreement: The purchase agreement between the entrepreneur and the consumer.

  • Webshop: fragrance-gems.nl.

  • Cooling-off Period: The period within which the consumer can exercise their right of withdrawal.

  • Right of Withdrawal: The option for the consumer to cancel the agreement within the cooling-off period.

ARTICLE 2 - APPLICABILITY

These terms apply to every offer from FragranceGems and every agreement reached between FragranceGems and the consumer. By placing an order, you agree to these terms. These terms are made available before the agreement is concluded and can be sent electronically free of charge upon request.

ARTICLE 3 - THE OFFER

  • All offers are without obligation unless stated otherwise.

  • The offer contains an accurate description of the products. Images are indicative; colors may vary due to screen settings.

  • Offers are valid while stocks last.

  • Prices: All prices are in Euros and are final prices. As we fall under the Small Business Scheme (KOR), we do not charge VAT. Shipping costs are clearly stated before checkout.

ARTICLE 4 - THE AGREEMENT

The agreement is finalized when the consumer accepts the offer and meets the set conditions. You will receive an order confirmation via email. FragranceGems reserves the right to refuse orders or set specific conditions for delivery.

ARTICLE 5 - PAYMENT

Payment is made via the methods offered in the webshop. If payment is not received on time, you will receive a reminder with a 14-day term. After this period, statutory interest and potential extrajudicial collection costs may apply.

ARTICLE 6 - SHIPPING AND DELIVERY

  • Delivery Time: 3–6 business days after payment (indicative).

  • Risk: The risk of loss or damage transfers to the consumer only upon physical receipt of the product.

  • Non-delivery: If delivery is impossible due to circumstances beyond our control, you have the right to dissolve the agreement free of charge.

ARTICLE 7 - RIGHT OF WITHDRAWAL (14-DAY COOLING-OFF PERIOD)

  • Term: You have 14 days from the day after receipt to withdraw without providing a reason.

  • Exceptions (Important for Perfumes): In accordance with Article 6:230p paragraph 2 sub b BW, perfumes with broken seals cannot be returned for hygiene and health protection reasons. Returns are only accepted if the product is unopened and in its original packaging.

ARTICLE 8 - RETURNS

  • Products must be returned in original, undamaged condition within 14 days of your withdrawal notification.

  • Return costs are at your own expense unless the product is defective or incorrect.

  • Refunds are processed within 14 days of receiving the return via the original payment method.

ARTICLE 9 - WARRANTY AND CONFORMITY

We guarantee that products meet the agreement. For defects arising within the first 6 months, it is assumed the defect existed at delivery. Warranty is void in cases of improper use, external repairs, or normal wear and tear.

ARTICLE 10 - COMPLAINTS AND DISPUTES

Complaints should be submitted via info@fragrance-gems.nl. FragranceGems is a member of Stichting WebwinkelKeur. Unresolved disputes can be submitted to:

ARTICLE 11 - INTELLECTUAL PROPERTY

All content, design, logos, and brands belong to FragranceGems. Copying or distribution without written permission is prohibited.

ARTICLE 12 - PRIVACY

We process personal data in accordance with the GDPR (AVG). Your data is used for order fulfillment and customer service and is never sold to third parties.

ARTICLE 13 - LIABILITY

Liability is limited to the order amount, with a maximum of €500. We are not liable for indirect or consequential damages.

ARTICLE 14 - FORCE MAJEURE

In cases of force majeure (e.g., natural disasters, pandemics, transport strikes) lasting longer than 90 days, both parties may dissolve the agreement in writing.

ARTICLE 15 - APPLICABLE LAW

Dutch law applies to all agreements. The court in The Hague (or the consumer's place of residence) has jurisdiction.
